TERMS OF SERVICE

If you have a problem with any of these terms, they may be changed if discussed with me prior to paying for the commissioned piece - the earlier we have these conversations the better!1. GENERAL TERMS
Work on this commission might be used throughout my content - this includes streaming the design on twitch, posting the VOD on Youtube, and more.
Prices are subject to change based on demand - this is discussed further throughout the terms of service.
I have the right to reject any order that I do not feel comfortable drawing for any reason.
If asking for an NSFW (Not Safe For Work) piece, ID will be checked to make sure you are 18+.
As the person creating the product I will be the one to determine if it is under NSFW guidelines
2. PAYMENTThe currency accepted is either USD and can be paid through PayPal exclusively.
Commissions can be paid either 100% upfront or split 50% upfront and 50% after sketch approval.
Do not send me any payment before I have agreed to give you a slot and requested you to send me the payment.
3. PROCESS AND DELIVERYI will notify you (referred to throughout this document as “the buyer” or “the client”) when I have started on the commission and you, therefore, lose the rights to a refund (see point 7 below for more info on refunds)
While I'm working on the commission I will update you on its progress to make sure it’s just right for you!
The amount of allowed revisions depends on the complexity of the work (See section 4 for more info).
During the reviews, you will see a work-in-progress, these images will usually include a watermark and be smaller than the finished piece. This is to ensure the safety of my content.
The length it will take to create the commission will depend on a variety of factors such as my personal schedule, the complexity of the commissioned piece, or any other factors that will be disclosed to you
The average time for a commission will be between 1 week - 3 weeks, depending. Unless the client and I have come to an agreement on a specified date. If anything comes up that will slow the progress of the initially estimated delivery time I will contact the buyer as soon as possible
Once the piece is finished the buyer will receive the.VRM and/or.Vroid file. This ensures the quality of the piece, and cannot be negotiated into another format
4. REVISIONS
The client will receive 3 rounds of specified changes on the commissioned piece included in the price.
A fee will be added if the buyer wants something changed on the final model or preset- unless a misunderstanding from my side has been made.
If the buyer wishes for me to change something in the drawing they have previously approved of, I will charge the buyer a fee to change it. The amount of the extra charge depends on the changes requested and is usually based on an hourly wage.
If the references or edits are unclear to start with, changes will come at an extra charge. To ensure this does not happen please be very specific in what you are looking for to make both of our lives easier
5. COPYRIGHT / USAGE POLICY
I, Lucy Aldra (the artist), hold all rights to the produced model, not the buyer. Therefore I am allowed to use the copyrighted artwork to:
Promote myself with it, anywhere I choose
Display it anywhere to my liking (website, social media, etc.)
Post it on a variety of platforms including but not limited to YouTube, Facebook, Twitter, Instagram, or Tiktok.
The buyer, so long as the artist has not rescinded the client’s copyright access to the artwork, is allowed to:
Use the commissioned piece for personal use unless agreed otherwise (the client can upload it on all their social media profiles, forums, etc.)
Use the model on stream and in videos and claim the character(s) as their own, but not the model itself.
Use the model to promote themselves. The Client must provide credit to the artist somewhere on the social media profile or in the description of a video.
Use the model on their Youtube channel or Twitch and in monetized videos as long as the artwork itself is not the main subject for the earnings.
If you do not wish the model to be posted on social media please state so upfront and we can discuss the conditions.
The following is considered copyright infringement:
Reproducing/using the copyrighted artwork commercially (including making money off it in any way)
Claiming the artwork as your own
Removing my signature from the artwork
Altering the artwork without my consent; I reserve the full rights to the image and its use/distribution unless otherwise agreed upon (rights to the image for your own non-personal use may be purchased at any time).
If any of this seems unclear, please reach out before signing. Copyright is a serious concern and must be understood in order for the commission to take place6. CUSTOMER SATISFACTIONI will do everything within my capabilities to ensure the client gets the product that they requested
If the buyer has a problem with anything in regards to the commissioned piece please tell me right away so we can find a solution together.
Open communication is a priority for all of my commissions. The more specific you are with the request, the better the piece will come out
7. REFUND / CANCELLATION POLICY
The buyer is not allowed a refund once work on the commission has begun (which the client will be notified about)
If for any reason I am unable to start the commission the buyer will receive a full refund.
If the buyer cancels their order before it has been started, the buyer can receive a full refund.
To receive a refund, it must be done through a transfer, not through Paypal chargeback
If the buyer requests a Paypal chargeback at any point when they were not allowed to ask for a refund, the client will lose all aforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way- this can include offering the commission to another person or putting it up for sale on a shop. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.
If the buyer breaks any of the points stated above they will lose all the aforementioned rights to the artwork commissioned by Lucy Aldra (the artist), and I will have the right to profit further from the commissioned artwork in any way I see fit. If you have a problem with any of these statements, they may be changed if discussed with me prior to paying for the commissioned piece.
